After a five-day trial in St. Louis County, the jury returned a unanimous defense verdict in under 30 minutes in favor of our client, an anesthesiologist. The case involved a claim of medical negligence and allegations that the anesthesiologist, with the resident physician who assisted him, improperly performed a popliteal nerve block procedure by injecting anesthetic just beneath the paraneural sheath, the outermost sheath layer surrounding the sciatic nerve and its branches. The plaintiff alleged the defendants thereby caused nerve damage resulting in numbness and weakness in his foot and toes. The defendants presented compelling evidence that the standard of care in performing an ultrasound-guided popliteal nerve block is to do exactly what the defendants did – inject anesthetic within the paraneural sheath – and that the plaintiff’s symptoms were caused by conditions and comorbidities independent of the nerve block procedure. Our team was well-prepared and presented a strong, evidence-based defense that resonated with the jury. Well done!
